Sample Water Utility Availability (WAC) Ordinance
 

AN ORDINANCE AMENDING ORDINANCE ___, ESTABLISHING
WATER RATES AND REGULATIONS FOR WATER SERVICES,
PROVIDING FOR THE COLLECTION THEREOF, AND REQUIRING
HOOKUP TO MUNICIPAL LINE.

WHEREAS, the City Council of the City of ______ has ordered a Water Improvement Study and a Water Rate Study to determine the cost of future improvements and rates to support the improvements and operation of the water system, and

WHEREAS, it has been determined by the _____ City Council to increase the Water Accessibility Charge (WAC), Base Water Fee and the Water Rates; and

THE CITY OF _____  DOES ORDAIN:

SECTION 1, A and B, and 1 and 2 of Section 1, and D. of Section 2 of City of _____ Ordinance No. ___ is hereby amended to read as follows:

SECTION 1:  WATER AVAILABILITY AND USE CHARGES.

A.  Water Rate and Water Availability Charge (WAC) Table:  To allow for current and future water system improvements that is based on a Water System Study provided by the City Engineer, a Water Rate Table has been provided to provide for annual rates for WAC Base Fees and Water Rates for the year 2000 through 2020 that shall be attached as a part of this Ordinance.  The rates shall be automatically increased according to the schedule.  The Water Rate Table shall be reviewed annually for consideration of changes in the WAC Base Fee and Water Rate structure.

B.  Availability Charge.  The owner or owners of any premises to which the City water system is reasonably available shall pay an availability charge of _____ each month as outlined in the Water Study Table and identified within the Table as Base Fees unless and until said premises is hooked up to the City water system; at such time as said premises is hooked up to the City water system, water rates for use of the City water system shall be paid as provided in Subdivision C of this Section.

C.  Rate Schedule (Use Charge).  From and after hookup of any premises to the city water system, the owner or owners of said premises shall pay for water used each month at rates fixed by ordinance of the City Council, and any rates so established may be amended at any time by duly adopted ordinance of the City Council.

From and after hookup of any premises to the City water system, the owner or owners of said premises shall pay for water used each month at the following rates:

1.  For the first 3,000 gallons or less, the charge shall be a minimum charge of ________ per month as outlined in the Water Rate Table and identified within the Table as Base Fees.

2.  For consumption of water in excess of 3,000 gallons, the charge shall be per thousand gallons ________, as outlined in the Water Rate Table and identified within the Table as Water Rates.

SECTION 2.  WATER LINE CONNECTIONS.

D.  Connection Charge.  The connection charge imposed by the City for hookup of premises to the municipal water system shall be _____ as outlined in the Water Study Table and identified within the Table as WAC Fees.  Such connection charge may be amended at any time by a duly adopted ordinance of the City Council.  The connection charges for duplexes, townhouses, apartment buildings and other multi unit building shall be 100% of the full connection charge for each unit.

SECTION 2.  This amending ordinance shall take effect on the ____ day of ______, 20__.

ADOPTED, by the City Council of ______, Minnesota, this _____ day of _____, 20__.
