AN ORDINANCE ENACTING POLICY FOR CONNECTION TO THE CITY WATER SUPPLY SYSTEM

The City Council of the City of ___________, Minnesota, hereby ordains:

SECTION 1: Unless the context clearly indicates otherwise, the following words and terms shall have the meaning set forth below: A. Person shall mean any natural person, or partnership, or association, private or public corporation. B. Private water supply system shall mean a system owned and operated by a person for collection and delivery of piped water for human consumption into commercial, industrial, or residential buildings or structures. C. Public water and supply system shall mean the City of _________ water supply system.

SECTION 2. No person shall build, establish, expand or maintain a private water supply system within the City of __________ unless there shall be no public water supply system within one-hundred (100) feet from the point on property of such person which is nearest the public water supply system. SECTION 3. This Ordinance shall be effective ________ (date). Any private water supply system which is in place and operational as of that date shall not be subject to this Ordinance. SECTION 4. Any person who shall have applied to the appropriate state agencies for permits to build and establish a private water supply system by _________ (date) shall not be subject to this Ordinance for the water system so applied for provided: a) Such person diligently pursues such application; and b) Such person commences construction of such system within ninety (90) days after obtaining such permits. SECTION 5. Each day any person is in violation of this Ordinance shall constitute a separate offense. SECTION 6. Any violation of this Ordinance shall constitute a misdemeanor.

ORDINANCE NO. _____: AN ORDINANCE AMENDING THE CITY OF ______ CITY CODE BY AMENDMENT TO SECTION _______ CONNECTIONS WITH WATER REQUIRED:

The City Council of the City of ________ ordains: Section 1a shall be added, Connections with Water Required. Section ____ of the City of ______ City Code is amended by adding the following: Section _______. Any buildings used for human habitation or for human occupancy, including all business buildings, unless specifically exempted by the Council on the grounds that no human beings occupy or use such buildings and no human needs are generated therein, located on property adjacent to a water main, or in a block through which the water extends, shall be required to petition for water service and to connect thereto when their present on-site water system fails. The owner of such property shall pay all assessments for water in accordance with the City of _______ assessment policies. No permits will be granted for reconstruction of existing on-site systems when City water service is available to such property. Agricultural buildings hereafter constructed within the City on property adjacent to a water main or in a block through which the water system extends, shall be provided with a connection to the municipal water system for all human needs. If sewer service is also available to that property, a petition for and a connection to the sewer system shall also be required and the owner of such property shall pay all assessments in accordance with the City of ________ assessment policies. Save as above amended, said City Code shall stand as initially passed and as previously amended. This ordinance shall be in full force and effect from and after its passage and publication according to the City Charter. Passed by the Council of the City of ________ this ________ (date).

ORDINANCE NO. ____ AMENDING _________ CITY CODE CHAPTER __ BY REQUIRING ALL CITY BUILDINGS AND RESIDENCES TO BE CONNECTED TO THE MUNICIPAL WATER SYSTEM AND PROHIBITING THE USE OF PRIVATE WATER SUPPLIES AND WELLS

BE IT ORDAINED, by the Mayor and City Council of the City of _______, County of _______, Minnesota as follows: Section 1. ______City Code Chapter __ shall be amended by adding thereto Section ____, which reads as follows: ____. Where the municipal water system is available to any parcel of property within the City of _______, the owner of such parcel of property shall make connection to the municipal water system within ninety (90) days after written notice of said availability has been served on the owner or occupant of the property. Where a parcel of property in the City of ________ has connected to the municipal water system or where the municipal water system is available to a parcel of property, no owner or occupant of the said property or any other person shall construct or make use of any private water supply or well on said property, except for such purposes as may be allowed by the ____ City Council. Section 2. Any person convicted of a violation of any of the provisions of this Ordinance shall be guilty of a misdemeanor. Section 3. This Ordinance shall become effective from and after its publication. PASSED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF _________, MINNESOTA THIS _________ (DATE).
